The Subscriber (location owner) is a legal and natural entity having advertised either on line or through an Easy Spaces sales representative.

Such advertisements are included in one of our free catalogues of location of private and corporate rentals via the EASY SPACES agency.

The User (buyer of a service): the user is a legal and natural entity surfing on the web or using https://easyspaces.fr website available functions

easyspaces.fr is the easyspaces.fr website providing visibility to one and several locations property of the subscribers whose sole agent is and will always be Easy Spaces.

Such visibility is limited to pictures and geography.

The client is a legal and natural entity booking a location among Easy Spaces’ internet catalogue offers, through Easy Spaces or through one of its sales agents,

The use of easyspaces.fr website and its access for consultations and transactions are governed by the French law and by the standard terms and conditions hereby mentioned.

Reproduction, publication, redistribution, transmission of easyspaces.fr website or any other form of use even if partial is strictly prohibited both for commercial and other use.

It is forbidden to copy, distribute, display, advertise or transfer the aforementioned contents of easyspaces.fr website or any part thereof unless prior written permission is granted by Easy Production.

Any individual who breaches the above mentioned rule shall be subject to legal proceedings.

Subscribers shall hereby authorize the Easy production company to release any provided advertisement in its original form and on any device.

By simply placing an ad through one of the provided online forms any Easy Production subscriber is authorized to release, exploit and put online any contents combining text and images.

By completing one of easyspaces.fr forms, even online, subscribers guarantee the authenticity of their personal data and all the provided information as owners of such property. 

Easy Production cannot be liable of any information, specified identity, descriptions and photos on easyspaces.fr website via its host and which will be put on line on its website.

Texts and photos provided and communicated to Easy Spaces or directly filed on easyspaces.fr website, by subscribers, are the sole responsibility of the latter.

Subscribers shall hereby certify to be the exclusive holder of the intellectual rights on the provided photos.

Subscribers formally guarantee Easy Production against any recourse, action or claim of any kind arising from third parties.

The Advertiser shall solely be responsible for its advertisement and the former shall indemnify and hold harmless Easy Production from any responsibility concerning any third party.

In case of complaint due to Easy Production omissions and errors linked to an advertisement, Easy Production shall be only responsible for the amount specified in the advertisement paid by the subscriber.

Any online advertisement appearing as incomplete or inconsistent shall not be taken into account.

Easy Production shall have the right to refuse locations and images which may damage the visual quality of the website, this being freely decided by Easy Production only.

The accepted subscribers shall mandatorily provide Easy Production with all the information required (incomplete documentation will not be considered)

Subscribers shall hereby pay subscription fees in the timeline laid down in the purchase order.

Easy production is not required to update or modify any subscriber advertisement.

Easy Production has the right to unilaterally terminate, after a formal notice has been given with no effect, any subscription signed with the subscriber in case this latter does not comply with one of the clauses of the agreement.

Subscribers, on the other hand, can unilaterally terminate the ended agreement, by a registered letter with advice of delivery addressed to 

Easy Production, 7 rue de Bône, 06400 Cannes, France department and subject to one month’s notice starting from the first day following the termination of the agreement.

In any case, any amount due shall be paid.

Easy Production does not guarantee the results following the advertising made by a subscriber.

Subscribers declare reading all usage, service and sale standard terms and conditions and acknowledge being responsible for the publication of advertisement submitted to easyspaces.fr and in compliance with the law in force.

Tarifs:

Prices and fees are expressed in Euros.

When T.T.C (including VAT) is specified, it means the VAT of the day in which the purchase order has been made.

Any rate variation shall impact on product and service price.

Easy Production has the right to modify its prices, fees and commission percentage in any moment, though being agreed that both prices and fees appearing on easyspaces.fr website the day the order is made, will be the only to be applied to subscribers and buyers.

Easy Production commission relevant to the space rental shall be charged to the client.

Easy Production fees shall be invoiced to clients based on the type of operation.

Such fees include: a commission on space rentals, managing the agreement and the rental contract, the time spent to select the best locations, visits organization, scouting locations...

Corporate subscribers shall pay 10% commission based on the price of their rental space to Easy Production as dealer.

A 10 to 15% commission shall be charged to clients based on the type of operation. 
Corporate subscribers, who do not want to pay commissions, should so indicate to Easy Production.

A rental commission fee ranging between 15 to 25% (excluding fees to consultants) will be charged to the client based on the type of operation.

Purchase orders, subscriptions and fees:

Subscribers and purchasers interested in buying a product and a service directly on easyspaces.fr website shall mandatorily:

– Complete the identification form as required

– Confirm the order after checking the selection made

– Make the payment as provided

– Confirm the order and payment.

Confirming the order implies the acceptance of the present terms of sale, the recognition to have completed its knowledge and the renunciation to take advantage of its own conditions of purchase or of any other conditions

The collected data in their entirety and the stored confirmation show the proof the business transaction was performed. 

The confirmation is worth a signature and implies the agreement to the business transaction made.

Easy Production shall confirm via e-mail, the recorded purchase order. 

Easy Production shall inform the subscriber, via e-mail, if the suggested location has been accepted or not

The subscriber interested in purchasing a product or a service by directly contacting Easy Spaces agency, shall mandatorily:

- Settle the amount due for the product availability online 

- Sign and put your initials on the standard terms and conditions of sale  

- Sign the purchase order by adding the date and the sentence: « signed as agreed »

- Provide 12 to 20 photos of at least 2000x1500 pixel size.

- Provide the owners’ form, duly completed.

The product will be available on line 15 days following the reception of the file as required.

The website is free for the private subscribers. 

The subscription will start on the day Easy Production has received the actual payment:

- for an unlimited period in case of private subscribers

- on a yearly basis for corporate subscribers. 

Following a year period after the subscription was made, and upon its sole discretion, Easy Production reserves the right to remove an online advertisement on its easyspaces.fr website, should it consider that such online location is not seen enough by the web surfers.

Either way, the amounts are due.

The Subscriber may request, at any moment, the full cancellation of his Subscription:

- by sending an email to : contact@easyspaces.fr

- by recommended letter with return receipt requested to Easy Production legal office address.

In all the above mentioned cases Easy Production will send a confirmation to the subscriber concerning the full cancellation of the Subscription.

Payment standard terms and conditions

Payment is due at the time of ordering.

Payments shall be made by credit card on easyspaces.fr website;  
the security platform used shall be PAYPAL, therefore no information shall be disclosed to any third party through the web.

The Subscriber shall be debited only the amount for the purchased or downloaded subscription for any selected service and product, as specified on the web.

Upon request made by the Subscriber, an invoice showing VAT if applicable shall be provided.

Payments can also be made by check or money transfer in compliance with the procedures specified on  easyspaces.fr website.
In both cases, the first day of subscription shall correspond to the day on which the incoming payment is expected.

Rental Standard Terms and Conditions  

Should Easy Spaces client confirm the rental of an advertised location, the Subscriber is committed to use EASY PRODUCTION / EASY SPACES as agent.

For a 5 years’ period following the 1^st visit or in the 3 years’ period following the 1^st rental, the Subscriber shall be obliged to contact EASY PRODUCTION / EASY SPACES, who will define the rental terms and conditions and will be entitled to a commission fee.

EASY PRODUCTION / EASY SPACES shall be the sole connection between the Subscriber and the client concerning any subject involving fares.

Should the subscriber directly rent to the client, the former will be liable of the total rental fee of the location/s, for the total period.

Liability

Easy Production, in the process of on-line sale, is held only by a best effort obligation; its liability cannot be committed for any damage resulting from using the Internet network such as loss of data, intervention, virus, break down of the service, or any other involuntary problems.

Personal Data  

In compliance with the law regulating informatics, files and as provided by the French law of January 6 - 1978, personal information of purchasing party shall be automatically processed.

Both Users and Subscribers have a right of access and rectification of personal data, as provided by the law of January 6 - 1978. Information automatic processing, including the email addresses of website Users has been declared to the CNIL under number 1211025.

Documents storage 

Easy Production will storage all purchase orders and invoices by a reliable and sustainable device being a faithful copy in compliance with article 1348 of the Civil Code.

Easy Production computerized registers shall be considered by the parties as real communications, orders, payments and transactions occurred between them.

Controversy 

Online sale terms and conditions shall be governed by the laws of France.

In case of controversy, the parties hereby shall submit to the jurisdiction of the courts of Nice.
